On June 3, 2024, Parents Defending Education (PDE) asked the Appellate Division, First Department, for permission to appeal to the New York Court of Appeals in IntegrateNYC v. State of New York. The lower court had dismissed the plaintiffs’ lawsuit, which challenges how New York City runs its public schools, but the Appellate Division reversed that ruling.
PDE argued that the state’s highest court should decide now whether these claims belong in court at all. Without that answer, the parties would spend years digging into the school system’s curriculum, admissions criteria, and hiring decisions, only for the Court of Appeals to address the core issue for the first time years later. A ruling now would either end the case and spare years of “unnecessary disruption and expense,” or settle the key questions for everyone.
