On January 16, 2024, Defending Education (DE) filed a request under New York’s Freedom of Information Law with the New York City Department of Education for emails about immigrant and migrant student education in the city. The Department asked for several extensions, and after a delay of more than two years, it still has not produced the records, even though state law requires it to.
On February 26, 2026, DE appealed to the Department’s general counsel, treating the long delay as a denial of the request and asking the Department to produce the records within 20 days.
Freedom of information laws exist to keep government and its officials accountable to the people they serve. DE looks forward to a quick resolution of this long-running effort to bring transparency to New York City’s schools.
