Parents Defending Education’s Comments on the Department of Education’s Request for Information Regarding Mandatory Civil Rights Data Collection

On February 10, 2022, Nicole Neily, president of Parents Defending Education, submitted comments to the U.S. Department of Education on proposed changes to the Civil Rights Data Collection (CRDC), a survey the Department’s Office for Civil Rights (OCR) requires public schools to complete.

As the comments state, “PDE vigorously opposes OCR’s proposed changes to the CRDC that will encourage schools to not only collect data on student sex identification, but will also empower schools to actively question and engage with children on gender and sexual identification issues that fall outside of the purview of public schools and are matters to be dealt with exclusively by parents.”

PDE asks OCR to withdraw the proposal. If it does not, PDE asks OCR to change the survey’s instructions to schools so that:
1) no public school district may discuss, ask about, or report on a minor student’s sex or gender behaviors or attitudes without parents’ knowledge and consent; and
2) no public school may report to OCR that a minor child is “nonbinary” without parents’ knowledge and consent.
