On September 12, 2022, Nicole Neily, president of Parents Defending Education, submitted comments to the U.S. Department of Education on its proposed changes to the rules carrying out Title IX. Title IX is the federal law that bans sex discrimination in schools that receive federal funds.
PDE’s comments argue that the proposed rule’s definition of “sex” conflicts with the plain words of Title IX, that it risks violating parents’ rights, and that its broad definition of “harassment” would threaten free speech. On sports, DE notes that “the Proposed Rule would violate the Title IX rights of female athletes to compete in single-sex sports. By requiring schools to allow biological males who identify as female to compete in women’s sports, the Proposed Rule would depart from the Department’s longstanding precedent, which it reaffirmed as recently as 2020. Ironically, the Proposed Rule would effectively require what Title IX was designed to prevent.”
Based on the foregoing concerns, PDE opposes the Proposed Rule in its entirety.
