Defending Education Sends Letter to Trump Administration Urging the Rescission of Biden Administration Title IX Rule

On June 10, 2026, Defending Education (DE) sent a letter to Secretary of Education Linda McMahon, Acting Attorney General Todd Blanche, and Deputy Attorney General Eric Hamilton. DE urged the Departments of Education and Justice to formally rescind the Biden administration’s Title IX rule, “Nondiscrimination on the Basis of Sex in Education Programs or Activities Receiving Federal Financial Assistance.”

The Biden rule transformed how Title IX works and ignored the law’s plain text. It was challenged in courts across the country, including in a successful lawsuit led by Defending Education. The rule redefined “sex,” which “unambiguously refer[s] to biological sex,” to include so-called “gender identity.” It also expanded the definition of “harassment” in a way that “flies in the face” of the limits the Supreme Court set on that term in a 1999 case. And the rule is unconstitutional because it would force students and faculty to use preferred pronouns, no matter what they believe.

DE urges the Departments to rescind the rule and bring the long fight over Title IX to a close.
