On August 14, 2023, Speech First, a national membership group of students, alumni, and others that defends free speech on campus, asked the U.S. Supreme Court to hear its challenge to Virginia Tech’s bias response team. Speech First argued that federal appeals courts are split, with the Fifth, Sixth, and Eleventh Circuits holding that bias response teams objectively chill students’ speech and the Fourth and Seventh Circuits holding that they do not.
