On April 8, 2024, Speech First, a national membership group of students, alumni, and others that defends free speech on campus, filed its reply brief in the U.S. Court of Appeals for the Fifth Circuit in its challenge to Texas State University’s (TXST) discriminatory-harassment policy. Speech First argued that the policy is viewpoint-discriminatory, overbroad, and content-based, that it has standing to challenge the policy, and that the university’s policy change did not make the claim moot.
