On January 17, 2024, Speech First, a national membership group of students, alumni, and others that defends free speech on campus, announced that it had appealed its lawsuit against Texas State University (TXST) to the U.S. Court of Appeals for the Fifth Circuit. The press release explains that TXST changed its harassment policy once it was clear the university would lose, but Speech First says the new policy still tramples students’ First Amendment rights and that, without a court ruling, the university could switch back at any time.
