On January 23, 2024, Alliance Defending Freedom (ADF) and the Manhattan Institute (MI) filed an amicus (“friend of the court”) brief in the U.S. Court of Appeals for the Fifth Circuit supporting Speech First’s challenge to Texas State University’s (TXST) discriminatory-harassment policy. The groups argued that the policy is antithetical to free speech because it makes protected speech punishable, and that the court should block it despite the university’s mid-lawsuit revision so TXST cannot go back to punishing protected speech.
