Speech First, Inc. v. Timothy L. Killeen, et al; BRIEF OF PLAINTIFF-APPELLANT SPEECH FIRST, INC.

On October 29, 2019, Speech First, a national membership group of students, alumni, and others that defends free speech on campus, filed its opening brief in the U.S. Court of Appeals for the Seventh Circuit in Speech First v. Killeen. The trial court had refused to issue a preliminary injunction, a court order that would block the university’s policies while the case goes on, ruling that Speech First did not have standing to sue and that part of the case was moot.

Speech First argued the trial court was wrong. It has standing to challenge the university’s ban on “bias-motivated incidents” and its use of “No Contact Directives” to silence speech. And the university’s decision to drop its prior-approval rule for election flyers after being sued did not make that challenge moot, because the university could bring the rule back at any time.
