Defending Education Files Opening Brief in Appeal to the 10th Circuit in Colorado Preferred Pronoun Case

On June 8, 2026, Defending Education (DE) filed its opening brief with the U.S. Court of Appeals for the Tenth Circuit in Defending Education v. Sullivan. DE argues that Colorado passed HB 25-1312, an amendment to the Colorado Anti-Discrimination Act, to punish dissenting views on sex and gender identity. DE members are being silenced because the state could realistically enforce the law against them. DE asks the court for a preliminary injunction, an order to stop the law while the case goes forward.

The brief also argues that the district court was wrong to rule that DE and its members lack standing, meaning the legal right to bring the case.
