Parents Defending Education v. New Trier Township High School District 203

Lawsuits

New Trier Township High School District 203 denied Parents Defending Education’s Freedom of Information Act request by merely stating that the request was “unduly burdensome”—without any further explanation.

Parents Defending Education (PDE), a nationwide membership organization whose members oppose political indoctrination in America’s schools, filed a complaint in the Circuit Court of Cook County, Illinois against New Trier Township High School District 203 for unlawfully withholding records of the District’s denial of a student activity commemorating Holocaust Remembrance Day.

New Trier Township High School District 203 denied Parents Defending Education’s request by merely stating that the request was “unduly burdensome”—without any further explanation. This baseless justification is insufficient to overcome the burden established by the Ilinois Freedom of Information Act. Thus, New Trier Township High School District 203 has violated the Illinois Freedom of Information Act by unlawfully withholding the requested records.

Parents Defending Education respectfully requests that the Court declare that New Trier Township High School District 203 unlawfully withheld the requested records in violation of Illinois Freedom of Information Act, enjoin New Trier Township High School District 203 from withholding the requested records and order them to release the requested records immediately, and determine that New Trier Township High School District 203 willfully and intentionally failed to comply with the Illinois Freedom of Information Act and impose appropriate penalties.
