Defending Education Urges Supreme Court to Grant Review in Case Pitting Labor Board Against Parents and School Districts

Rocklin Unified School District v. Public Employment Relations Board

On May 18, 2026, Defending Education, Advancing American Freedom, and other organizations filed an amicus (“friend of the court”) brief asking the U.S. Supreme Court to hear Rocklin Unified School District v. Public Employment Relations Board. In this case, a California state labor board threw out a school district policy that required schools to tell parents when a student tries to socially transition their gender at school.

The district asked the Supreme Court to decide three related questions:

  • whether the labor board’s ruling violates parents’ Fourteenth Amendment right to direct the upbringing and care of their children
  • whether California’s system, which lets a state labor board settle disputes involving constitutional rights, gives people the fair process the Constitution requires
  • whether the labor board went beyond its authority by judging whether a school board’s parental-notification policy is legal

These questions involve parental rights, government power, and basic legal protections. Defending Education hopes the Supreme Court will take the case and settle them in California and across the country.
