Defending Ed Files Amicus Brief to Prevent Environmental Activists from Circumventing the Ballot Box

Dunn v. Public Service Commission

On November 14, 2025, Defending Education (DE) filed an amicus (“friend of the court”) brief in Dunn v. Public Service Commission, supporting the defendant’s request to dismiss the case entirely.

In Wisconsin, environmental activist groups that oppose common-sense energy policies have failed to win over voters or elected officials. So they are trying a new approach: climate lawsuits, with children named as plaintiffs, that ask courts to order sweeping renewable energy mandates. These groups hope sympathetic child plaintiffs will help them overturn policies they couldn’t defeat at the ballot box. But these lawsuits don’t reflect the views of most American families, who support continued use of gas, oil, and coal to keep energy affordable.

Climate activists are free to disagree and to urge voters to support tighter limits on fossil fuels. What they can’t do is ask judges to settle that policy debate for them.
