In August 2024, the U.S. Court of Appeals for the Eleventh Circuit granted an “injunction pending appeal” in the Title IX lawsuit brought by Alabama, Florida, Georgia, South Carolina, and several organizations, including Parents Defending Education. The order stops the U.S. Department of Education from enforcing its new Title IX rule in those states while the appeal goes forward. The rule had expanded the meaning of discrimination “on the basis of sex” to include gender identity and changed the rules for handling sexual-harassment cases. A lower court had refused to block the rule just one day before it was set to take effect.
