Hayward Unified School District resolution declares the district a ‘Permanent Sanctuary District’ for LGBTQIA+ students, staff & families; prohibits staff from notifying parents of their own child’s new gender identity and accommodations at school; requires “Progress Pride flag” be flown at every school site indefinitely

On February 12, 2025, Hayward Unified School District (HUSD) unanimously passed a resolution declaring the district a “Permanent Sanctuary District” for LGBTQIA+ students, staff & families.

It includes prohibiting staff from revealing to parents a student’s “gender identity,” allows students to use restrooms and facilities that ‘align with their gender identity,” and states that “attempts to redefine gender and gender identity in federal laws and policies undermine the rights and dignity of transgender and gender-diverse individuals.”

The resolution states that “attempts to redefine gender and gender identity in federal laws and policies undermine the rights and dignity of transgender and gender-diverse individuals,” but the district will “steadfastly uphold protections for all students and staff regardless of potential changes at the federal level in accordance with California State Law and existing HUSD Board Policies.”

The district also “recognizes the individual and specific needs of each transgender, non-binary and gender non-conforming student and recommits to offering gender support and/or accommodations, referrals and resources for their physical safety and mental-well being.”

The resolution declares that the district a “a permanent Sanctuary District for LGBTQ+ students, staff, and families, ensuring their full rights to safety, dignity, and self-expression.”

Additionally, the resolution states that the district will:

  • “Maintain restrooms and facilities so that students may use restrooms and facilities that align with their gender identity and ensure these choices are respected and treated as confidential by staff,”
  • “Permit all students, regardless of gender identity, to equal access to sports programs, extracurriculars, co-curriculars, and any school activity, free from discrimination in alignment with CIF-NCS regulations,”
  • “Prohibit HUSD staff from sharing any information about a student’s gender identity, asserted pronouns, or asserted name with anyone, including family members, without the student’s explicit consent.”
  • “the Progress Pride Flag will be flown at every HUSD site indefinitely as a symbol of unwavering support and solidarity with LGBTQ+ communities.”

The resolution concludes by stating that “no one can be groomed into an LGBTQ+ identity, and that policies and rhetoric designed to deny these truths are hateful attempts to sow division and perpetuate discrimination.”
