Parents Defending Education and Defense of Freedom Institute send letter to The White House on Strengthening and Preserving the Original Intent of Title IX

On February 19, 2025, Parents Defending Education and the Defense of Freedom Institute sent a letter to James Braid, Director of Office of Legislative Affairs concerning the President’s directive to the White House Office of Legislative Affairs to prepare bill text codifying certain definitions set forth in Executive Order 14168, Defending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government (“EO14168”).

DFI and PDE share a strong interest in the continued vitality of Title IX of the Education Amendments of 1972 (“Title IX”) in guaranteeing equal educational opportunities for women and girls in federally funded schools, colleges, and universities and in defending the law from efforts by extremist politicians and bureaucrats to dismantle its protections. To advance that interest, DFI and PDE filed separate lawsuits against the Biden Administration’s 2024 Title IX rule, which illegally redefined the law to prohibit discrimination on the basis of “gender identity” and to force schools to allow biological males to access intimate facilities designated for women and girls. The litigation commenced by DFI and PDE (with other plaintiffs) obtained preliminary injunctions against implementation of that rule in a total of eight states before the U.S. District Court for the Eastern District of Kentucky ultimately vacated the rule entirely on January 9, 2025.

We write this letter to express our deep appreciation of President Trump’s landmark executive action to protect women and girls from the harms of gender ideology in American education and to offer guidance, in the form of a draft model law, on codifying the President’s definitions of “sex” and related terms in Title IX—along with other provisions that would restore the original meaning of the statute and protect it from future attacks by administrative agencies that are not accountable to Americans.
