Parents Defending Education Reply to Motion to Dismiss in NYC Education Lawsuit

On January 24, 2022, Parents Defending Education filed a reply in support of motion to dismiss in New York in IntegrateNYC v. the State of New York et. al. 

In this case, Parents Defending Education has asked the court to dismiss the lawsuit filed by Integrate NYC against the city and state, which alleges the city’s specialized high schools are systemically racist.

PDE’s motion to dismiss asserted that the race-balancing that Plaintiffs’ disparate impact theories would entail could itself violate the Equal Protection Clause and other bans on intentional racial discrimination – and accordingly, calls upon the Court to dismiss Plaintiffs’ amended complaint in its entirety.
