On August 21 2025, Defending Ed filed an amicus brief in opposition to yet another school district’s parental exclusion policies.

All across the country, policies allowing school personnel to socially transition young children in secret—giving children new names, pronouns, restroom usage, and field trip bunk selection—are exploding.

Parents are left in the dark, and even when they sue in federal court, are finding themselves without recourse when activist judges determine they lack standing to challenge these school policies. Defending Education aims to change that. Our brief in the case of Foote v Ludlow School Committee points out that of all the rights a parent must have in raising their child, it must be to know how that child identifies at school.

Schools that actively deceive parents are not meeting the required constitutional standard when they burden the parental right–recognized by the Supreme Court in 2000 as the oldest of the fundamental rights ever recognized. We won’t rest until the millions of parents who have been cut out of their child’s education and development regain their voices at school.
