Defending Education Files Opening Brief in Appeal to the 10th Circuit in Colorado Preferred Pronoun Case

On June 8, 2026, Defending Education filed its opening brief with the U.S. Court of Appeals for the Tenth Circuit in Defending Education v. Sullivan. In the brief, DE argues that Colorado has adopted HB 25-1312, an amendment to the Colorado Antidiscrimination Act, to punish dissenting views on sex and gender identity, that its plaintiff members are being silenced because of the law’s credible threat of enforcement by the state, and requests a preliminary injunction to halt the policy pending the litigation.
Additionally, DE argues in its brief that the District Court erred in determining that it and its plaintiff members lack standing.
